The Terms of Use Policy is incorporated here in full and is a part of this policy. In addition to those terms, in creating an account with, making any submission to, or placing any purchase from Sucre, you agree as follows:

AGE REQUIREMENT
You must be at least 18 years of age to use our Service. If you, your parent or guardian, have any concerns please feel free to contact us.

YOUR SUBMISSIONS
You may submit certain material to Sucre as part of your use of the Service (“Submissions”). You acknowledge and agree that, by submitting any text, images, data, or other materials ("Content") to Sucre, you grant to Sucre the right to use that Content in any form, media or technology now known or hereafter developed for the purpose of completing your Order and displaying your Shopping Cart in your account. By submitting Content to Sucre, you acknowledge that you have the authority to grant such rights to Sucre. You acknowledge that Sucre has no obligation to monitor your access to, or use of, the Service, but has the right to do so for the purpose of operating the Service, to ensure your compliance with these Terms or to comply with applicable law or the order or requirement of a court, administrative agency or other government body.

Sucre has no obligation to monitor the Site or Site-related services. However, you acknowledge and agree that Sucre has the right to monitor the Site and Site-related services and to disclose to any third party any information in order to operate the Site properly, to protect itself and its customers and to comply with legal obligations or governmental requests. Sucre reserves the right to immediately terminate any individual's use of the Site and/or such user's password(s) or account(s) in the event of any conduct by such user which Sucre, in its sole discretion, considers to be unacceptable, or in the event of any breach by such user of this Agreement. Such termination may occur without notice to the user.

MAKING PURCHASES
In making any purchase of products or services described on the Site, you will be asked to supply certain information including but not limited to credit card or other payment information. You understand that any such information will be treated by Sucre in the manner described in its Privacy Policy. You agree that all such information that you provide will be accurate, complete and current. You agree to pay all charges incurred by users of your account and credit card or other payment mechanism at the prices in effect when such charges are incurred. You will also be responsible for paying any applicable taxes relating to your purchases. Moreover, you agree to review and to comply with the terms and conditions of any specific agreement that you enter into with any merchant and/or service provider in connection with the licensing or purchase of any product or service.

Sucre reserves the right to refuse to fulfill any order or purchase. In such an event, your payment will be refunded.

THE SERVICE AND PRODUCTS AVAILABLE THROUGH SUCRE’S SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SUCRE EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. SUCRE MAKES NO WARRANTY THAT ITS PRODUCTS WILL BE FREE FROM ANY AND ALL DEFECTS. SUCRE MAKES NO WARRANTY REGARDING ANY GOODS, SERVICES, SPECIAL OFFERS, OR THE DELIVERY, QUALITY, ACCURACY, TIMELINESS, COMPLETENESS OR RELIABILITY OF ANY GOODS OR SERVICES PURCHASED, ACCESSED OR OBTAINED THROUGH SUCRE’S SITE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM SUCRE OR THROUGH THE SITE OR SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL SUCRE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS OR OTHER INTANGIBLES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, EVEN IF SUCRE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, THAT RESULT FROM YOUR ORDER OR GOODS OR SERVICES ON THIS SITE, EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. YOU AGREE THAT THE AGGREGATE LIABILITY OF SUCRE TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE USE OF THE SITE OR SERVICE IS LIMITED TO $100. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT SUCRE HAS SET ITS PRICES AND ENTERED INTO THIS AGREEMENT IN RELIANCE UPON THE LIMITATIONS OF LIABILITY SPECIFIED HEREIN.

DELIVERY DELAYS
Sucre is not responsible for or liable to you for any delays attributable to the delivery of Products to you, regardless of whether that delay is caused by its sole negligence or that of a third party.

CUSTOMER SATISFACTION
Sucre wants you to be completely satisfied with your purchase. For custom made and special order, most articles are accepted only for credit or exchange, and only if defective in workmanship or quality as determined by Sucre. Requests for return must be made within 30 days of date of delivery.
